For many of us, the purchase of our homes will likely be the most expensive and important investment that we make. The professionals with which you will come into contact during any residential real estate transaction include, but may not be limited to, real estate agents, professional engineers and/or home inspectors, professional surveyors, mortgage brokers and/or other mortgage representatives, title insurance companies and their independent agents, and, of course, an attorney who may be representing the other party.

The importance of appropriate legal counsel in a real estate transaction exists even prior to the time that you sign an Agreement of Sale to either sell or purchase property. In New Jersey, Buyers and Sellers have what is known as the three day attorney review period. Simply, either the Buyer or the Seller will have three days from the time that they have received the fully signed copy of the Contract to engage the services of an attorney to review the Contract and, if the attorney is dissatisfied with the terms of the Contract, disapprove of it within the three day period. I have found that my representation is more efficient when clients provide me with a Contract even prior to the time that they have signed it. The benefit of effective legal representation from the onset of any real estate transaction cannot be overstated. In addition to reviewing the Contract and preparing any amendments to it, if necessary, you will need to ensure that the home is appropriately inspected, that the mortgage application and documents that are being presented to you are in your best interest, that the terms of the Contract, including any potential repairs to the property, are effectively negotiated for you and reduced to the appropriate writing so that they are enforceable.
